When Canadians defend themselves or their families against a break-in or home invasion, they often end up treated as criminals. Too often, they're taken away by police and forced into costly legal battles to prove they acted in self-defence.
This is not right.
Common sense Conservatives believe that you shouldn't be criminally charged for acting in defence of yourself, loved ones, your home or property.
Canadian law currently requires that any force used for self-defence or defence of property must be "reasonable in the circumstances". Despite the musings of some legal experts and defence lawyers, Conservatives believe that our current laws lack clarity.
Although the Conservative Opposition has urged the Carney government to work with us on this issue over the past year, the Liberals have refused to act.
So, on March 12, 2026 Conservatives introduced Bill C-270, the Stand on Guard Act.
Our legislative proposal aims to further clarify Canada's self-defence laws and reduce the risk of prosecution for individuals who defend themselves against intruders by amending Section 34 of the Criminal Code of Canada so that force is presumed to be justified if used against an illegal intruder.
We're responding to growing public concern over the dramatic increase of break-ins and home invasions here in our community, the broader Durham Region and Greater Toronto Area.

Whereas You deserve the right to defend your home, property and loved ones if an individual breaks into or invades your home;
Whereas Current Canadian law clearly lacks clarity on self-defence provisions,
Whereas Liberal catch-and-release justice has made Canadians more vulnerable to the violent crime wave sweeping our nation; and,
Therefore We, the undersigned, call upon the Liberal government and all Parliamentarians to pass the Conservatives' Stand on Guard Act without delay.
